Marriage Validation Lawsuit Rejected, Rizky Febian and Mahalini Advised to Remarry

Kapanlagi.com - The marriage validation lawsuit of celebrity couple Rizky Febian and Mahalini has officially been rejected by the South Jakarta Religious Court. Their marriage was declared invalid according to both religious and state laws due to the failure to fulfill one of the marriage requirements.

The spokesperson for the South Jakarta Religious Court, H. Suryana, provided an explanation regarding this decision when met in his office on Monday (25/11/2024).

“This is indeed the view of the community, the judge's guardian that the guardian appointed or chosen by the parties or family members is not a legitimate guardian. In fact, the law does not state it that way. There are even those who refer to it as a muhakam guardian, a guardian appointed by the parties. That is still present in society,” explained H. Suryana.

This decision was made because it was found that the guardian used in Mahalini's marriage was a guardian appointed by the family, not a legitimate guardian according to Islamic law. As a result, their marriage validation lawsuit could not be granted.

“Automatically rejected, because one of its requirements was not fulfilled. In order to obtain a marriage certificate, to have a marriage that is valid according to religious and state laws, they must remarry,” said H. Suryana.

1. Court Suggests Remarriage

The court also suggested that Rizky Febian and Mahalini proceed with remarriage according to the applicable legal procedures. Regarding the timing of the remarriage, H. Suryana stated that it entirely depends on the decision of Rizky and Mahalini.

“When will the marriage take place? It depends on the individuals involved. That is a personal matter. After this ruling, they should immediately take care of the requirements,” he continued.

Although their marriage is declared legally invalid, H. Suryana emphasized that both are still considered husband and wife based on their perspective.

“They are still husband and wife. Their assumption is that it is valid because they do not understand. They think there is no problem, because it was covered, right? They are not aware of the details, they just know it is settled,” he revealed.

2. Rizky Febian Is Not Guilty

H. Suryana also emphasized that Rizky Febian cannot be blamed in this case. According to him, Rizky was just following the process set by the family without knowing about any discrepancies in legal procedures.

“The fact of the marriage is that, actually, Rizky is not at fault; he handed everything over. In our opinion, he was not aware of anything; he just knew it was settled. Legally speaking, if a person does not know, they cannot be judged as wrong. Because they may not know,” he explained.

Remarrying becomes the only solution for their relationship to be officially recognized by the state and religion. This case also serves as an important lesson for other couples to ensure that all the requirements and conditions of marriage are fulfilled before conducting the marriage contract.
