Rehabilitation Assessment Approved, Here's Why Jeff Smith is Still Detained

Kapanlagi.com - The trial for the alleged drug abuse involving Jeff Smith was held for the first time at the West Jakarta District Court on Wednesday (28/7/2021). The trial immediately carried out three agendas at once, namely the reading of the indictment, listening to witness testimony, and examining the defendant.

In the trial, it was revealed that the investigators had submitted an assessment to the Provincial National Narcotics Agency (BNNP) since early May. The result is that the actor has been approved for rehabilitation.

This submission is related to the evidence, which weighs only 0.3 grams. Because according to the Supreme Court Circular Letter Number 4 of 2010, evidence weighing less than one gram can undergo assessment.

"Alhamdulillah, my client Mark Jeffrey Smith has been assessed by investigators at the BNN. This means that the assessment is for rehabilitation. Because if we refer to the Supreme Court Circular Letter Number 4 of 2010, it states that drug abuse must be rehabilitated. And looking at the facts of the trial, where the evidence found was only 0.3 grams, it means that it is below the Supreme Court Circular Letter," said Aldi Surya Kusumah, Jeff's legal representative, after the trial.

1. Still Detained Despite Being Rehabilitated

Although he has been approved for rehabilitation, Jeff Smith is still being held at the West Jakarta Police Detention Center as a prosecutorial detainee. The detention is related to two charges filed against him.

As known, Jeff is charged with two articles, namely Article 111 Paragraph 1 and Article 127 Paragraph 1 of Law No. 35 of 2009 concerning Narcotics. Article 111, which relates to the possession of marijuana, is the reason for his detention.

"Jeff is currently in detention. Actually, he has reached the second stage of detention at the Prosecutor's Office, but because of the current COVID situation, he has been entrusted to the West Jakarta Police Detention Center as a prosecutorial detainee," said Aldi Surya.

"Because if it's Article 127, it's a single-substance article that can be directly rehabilitated. But because here there is possession of goods under Article 111, there needs to be detention. So, it's still rehabilitation, it's a form of rehabilitative punishment," he concluded.
