Kapanlagi.com - Defendant Gaung Sabda Alam Muhammad or better known as Gaga Muhammad was sentenced by the panel of judges of the East Jakarta District Court to four years and six months for a traffic accident case. Responding to the verdict from the panel of judges, Gaga Muhammad plans to appeal.
"If you have heard the verdict yourself, where the panel of judges decided on 4.5 years, I told Gaga to think about it. We have seven days to make a decision, whether to appeal or not," said Gaga Muhammad's lawyer, Fahmi Bachmid, at the East Jakarta District Court on Wednesday (1/19/2022).
Fahmi assessed that Gaga Muhammad still has seven days ahead. However, it is highly likely that they will file an appeal.
"But it is highly likely that we will file an appeal, but we are still considering the appeal time within seven days after this verdict, no later than seven days after it is decided. Whether to appeal or not, we will decide in seven days, but it is highly likely that we will appeal," said Fahmi.

Fahmi has reasons why Gaga Muhammad filed an appeal after being sentenced to four years and six months in prison. According to Fahmi, there is an issue regarding differences in perception during the trial.
"There is a problem of different perceptions, different views from the judges' considerations. They perceive what we present as assumptions, whereas those are facts presented in the trial, not assumptions, they are realities. I will submit all of this in the upcoming appeal," Fahmi said.
"The reasons for our appeal will be clearly stated, there are several things that we have noted about the facts in the trial, namely about two incidents that until now I believe were due to negligence at kilometer 70 which resulted in an incident at the hospital," Fahmi added.

Gaga Muhammad has been sentenced to four years and six months in prison for a traffic accident that caused Laura Anna to be paralyzed. This punishment is the same as the demand of the Public Prosecutor who demanded Gaga to be sentenced to four years and six months in prison.
"Declares the defendant proven guilty of driving a motor vehicle due to negligence that caused serious injury to the victim. Sentencing to 4 years and 6 months imprisonment, a fine of Rp. 10 million, with a substitute of 2 months imprisonment if the fine is not paid," said the judge during the trial.

Then, the panel of judges stated that there are several factors that aggravated Gaga Muhammad's punishment. They stated that Gaga Muhammad did not show remorse.
"What aggravates the defendant in the trial is that he expressed regret and guilt, but the panel of judges did not see consistency in those statements," said the judge.
"In the trial, the defendant did not show remorse. Instead, he tried to find elements of negligence and the consequences of the serious injuries suffered by the victim, claiming that it was part of the victim's own fault, namely that the victim did not use a seat belt," the judge added.

Not only that, the judge also mentioned that Gaga Muhammad did not provide any assistance to the victim, namely Laura Anna. Especially regarding compensation during treatment.
"Did not provide any material assistance or good intentions to help the victim's family face the paralysis experienced by the victim, so the victim's family demanded compensation of 12.6 billion rupiah," concluded the judge.
