Tok! Gaga Muhammad Sentenced to 4 Years and 6 Months in Prison

Kapanlagi.com - The verdict hearing of defendant Gaung Sabda Alam Muhammad, or better known as Gaga Muhammad, for a traffic accident case was held at the East Jakarta District Court on Wednesday (19/1/2022).

In the verdict hearing, the panel of judges at the East Jakarta District Court officially sentenced Gaga Muhammad to four years and six months in prison.

The 21-year-old influencer was found guilty of a traffic accident case that caused his ex-girlfriend at the time, Laura Anna, to become paralyzed. This punishment is the same as the demand of the Public Prosecutor who demanded Gaga to be sentenced to four years and six months in prison.

"Declares that the defendant is proven legally and convincingly to have driven a motor vehicle negligently, causing the victim to suffer serious injuries. Sentencing him to four years and six months in prison, a fine of Rp. 10 million, and if not paid, to be substituted with two months of imprisonment," said the judge during the trial, Wednesday (19/1/2022).

1. Things that Aggravate

Then, the judge conveyed that there are several things that aggravate Gaga Muhammad's punishment. He stated that Gaga Muhammad did not show any remorse.

"What aggravates the defendant in the trial is that he expressed his regret and guilt but the judge did not see consistency in those statements," said the judge.

2. Instead, Seeking the Victim's Fault

Instead of showing remorse, Gaga was considered by the judge to be seeking faults from the victim.

"In the trial, the defendant did not show any remorse, instead, he tried to find elements of negligence and the severe injuries suffered by the victim are part of the victim's own fault, namely the victim's failure to use a seatbelt," continued the judge.

3. Not Providing Any Assistance to the Victims

Not only that, the judge also mentioned that Gaga Muhammad did not provide any assistance to the victim, namely Laura Anna.

"Not providing any material assistance or good faith to help the victim's family face the paralysis experienced by the victim, so the victim's family demands compensation of 12.6 billion rupiah," he said.

4. Actions That Are Not in Accordance with Religious Norms

The panel of judges continued their testimony that the defendant started the criminal act with something prohibited by the religion he adhered to.

"The criminal act was initiated by the act of being drunk, consuming alcoholic beverages that are not in accordance with the religion the defendant adheres to," he added.

5. Things that Lighten

Besides being burdensome, there are several things that lighten Gaga Muhammad's punishment.

"Mitigating circumstances, the Defendant is still young and can still change his behavior for the better. Considering that the defendant has already served detention, the detention period is reduced by the period of detention that has been carried out," the panel of judges concluded.
