Lawyer Vadel: This Case Would Not Have Happened If LM Had Been Accepted Back by Nikita Mirzani

Vadel's attorney, Oya Abdul Malik, firmly stated that this entire series of events would never have occurred if LM had been accepted back by her mother, Nikita Mirzani, when she returned from England.

Oya revealed facts from the trial that LM had made several attempts to return home, but her efforts were always rejected. Vadel and his family even reportedly accompanied LM directly from the airport to her mother’s house, but the door was never opened. This rejection is considered to have led LM to seek protection elsewhere.

1. The Trial Will Never Happen

According to Oya, if only the door of that house had been open for LM, the trial that sentenced Vadel to 9 years in prison would never have happened.

"In front of the assembly, LM stated that he tried six times to return to his mother's house, but was not welcomed by her. My question is, would the incident that is being decided today have occurred if his mother had accepted him back? It would not have happened," emphasized Oya Abdul Malik in South Jakarta, Wednesday (1/10/2025).

Oya also mocked the reporting party who vigorously advocates for child protection, yet in reality, the child is not under their protection.

"And until today, Lolly is not at her mother's house. The one who claims to be busy protecting her child, accusing Vadel of ruining her child's future, but until today her child has not been accepted back into her home," she said.

3. Can't Stand Being in the Safe House?

In fact, Oya revealed LM's complaints in court regarding her current condition. "When asked by the panel, 'Has Lolly returned home yet?' 'Not yet, Your Honor.' 'I am still in the safe house and I can't stand it, Your Honor.' That is the fact presented in court," said Oya.

4. LM's Request Letter Was Never Heeded

She also showed evidence of LM's request letter to meet her mother that was never acknowledged, strengthening her argument.

"With this, Lolly asks Mimi to take the time to meet, even if just for 10 minutes.' And the door was still not opened," Oya concluded while reading the contents of the letter.

5. Factors That Complicate

The 9-year prison sentence handed down to Vadel Badjideh in the case of sexual intercourse and abortion involving Nikita Mirzani's daughter is not without careful consideration by the panel of judges. There are several factors that aggravate Vadel's sentence, starting from his actions which are deemed to cover up mistakes with new wrongdoings to exploiting the disharmonious relationship between the victim and her mother.

One of the main points that aggravates Vadel is his actions, which are considered contrary to religious norms and societal decency. The judge also highlighted how Vadel handled his mistakes, which was deemed unmanly.

"The aggravating factors present in the defendant. The actions of the defendant are contrary to religious norms and decency that live and grow in society," said the Chief Judge.

6. Exploiting Disharmonious Relationships

In addition, the judge assessed that Vadel took advantage of the conflict situation between the victim and her mother, Nikita Mirzani. The lack of peace efforts between Vadel and the victim's side also became a special note that further weighed down his position in the eyes of the law.

"The defendant exploited the disharmonious relationship between the victim's child and the witness, the mother of the victim's child. The absence of reconciliation between the defendant and the victim's child," he said.

7. Appeal

The 9-year prison sentence received by Vadel Badjideh is lighter than the demand from the Public Prosecutor (JPU). Previously, the prosecutor demanded that Vadel be sentenced to 12 years in prison and a fine of IDR 1 billion, with a subsidiary of 6 months in detention.

After the verdict, Oya immediately stated that they would file an appeal regarding this matter. "We will file an appeal, Your Honor," said Vadel Badjideh's legal advisor, Oya Abdul Malik, shortly after the reading of the verdict at the South Jakarta District Court, Wednesday (1/10/2025).
