Dispute Still Unresolved, Ruben Onsu Once Again Loses to PT Ayam Benny Sujono for Design Ownership

Kapanlagi.com - Ruben Onsu once again has to face the reality regarding the dispute over his food business with PT Ayam Benny Sujono, named I Am Geprek Bensu. This time, the judges of the Central Jakarta Commercial Court have determined that the industrial design on the packaging of Geprek Bensu belongs to PT Ayam Benny Sujono.

This was confirmed by the Public Relations of the Central Jakarta Commercial Court, Bambang Nurcahyo, when contacted by the media on Saturday (12/9). He confirmed that Ruben, as the defendant, once again lost in terms of the design of his trademark.

"I just received information that the decision has been made, and Ruben Onsu, as the defendant, lost in terms of the graphic design of the packaging," said Bambang Nurcahyo.

1. There is Already a Decision

Although he has confirmed the news, Bambang apparently cannot show the content of the decision. Not without reason, Bambang said that the decision is currently still in the process of archiving.

"But the panel of judges has told me that Ruben Onsu as the defendant lost and the decision was made yesterday," he said.

2. Certificate Scratched and Revoked

Meanwhile, based on the decision, the legal counsel of PT Ayam Benny Sujono, Eddie Kusuma, when contacted separately, said that Ruben Onsu had copied all aspects of his client's company. Eddie even mentioned one of the contents of the decision where the Directorate of Copyright and Industrial Design of the Directorate General of Intellectual Property Rights of the Ministry of Law and Human Rights will scratch and revoke the certificate owned by Ruben Onsu related to the industrial design.

"This means that Ruben Samuel Onsu's packaging box is a replica or imitation, not a new form and configuration or novelty," said Eddie.

"I don't want to suspect the Directorate of Trademarks and Geographical Indications. The Supreme Court's decision has legal force. However, the Directorate of Trademarks and Geographical Indications is still delaying the implementation of the Supreme Court's decision," he continued.

3. Not Speaking Out

Until now, Ruben Onsu has not provided an explanation regarding this long-running trademark dispute. Ruben Onsu has also lost to PT Ayam Benny Sujono regarding the ownership of the trade name Bensu or Geprek Bensu.
