Kapanlagi.com - Gaga Muhammad's mother, Janariyah, and her lawyer, Fahmi Bachmid, submitted an appeal memorandum at the East Jakarta District Court on Tuesday (8/2/2022). It is known that Gaga Muhammad was sentenced to 4.5 years in prison in a traffic accident case.
Janariyah stated that the 4.5-year prison sentence imposed by the judge at the East Jakarta District Court on Gaga Muhammad is considered too harsh. It is because of this sentence that Janariyah filed an appeal against the judge's decision.
"Oh yes, that's why we filed an appeal," said Janariyah at the East Jakarta District Court on Tuesday (8/2/2022).

At least, the appeal made by Janariyah can lighten the punishment for Gaga Muhammad. For Janariyah, the punishment for her son is still too heavy.
"At least Gaga gets justice, because he is still too young so he should get justice. At least his punishment is reduced," she said.

Previously, Gaga Muhammad was accused of negligence regarding the accident that happened to Laura Anna in 2019. Janariyah mentioned that Gaga Muhammad also tried to help with the medical expenses for Laura Anna after the accident in December 2019.
"If we talk about the assistance at Mayapada hospital, Laura's parents conveyed to Gaga, 'Ga, what about this? We have to pay the hospital bill.' Then Gaga said, if my family can't help yet, but I will find a way to solve it," said Janariyah.

"He (Gaga Muhammad) will communicate with his friends and he can get assistance at that time, around Rp 180 million and Rp 40 million to Mayapada. The Rp 140 million or so will go directly to the late Mother Laura's account," said Janariyah.

In this appeal, Fahmi explained that there are eight points raised by Gaga Muhammad. The first one is related to the cause of the late Laura Anna's paralysis.
"I only provided the illustration, the essence is there are 8 reasons for filing an appeal. The first reason is that there is an error in concluding that the victim, Laura Anna, became paralyzed on December 8, 2019. Here is the first reason, there was a mistake as if Laura became paralyzed on December 8, but in fact, it was not like that," said Fahmi.
"The second reason is that there is an error in seeing paralysis as a result of Gaga Muhammad's actions, so Gaga Muhammad was negligent, yes. But causing paralysis has not been proven in this trial," Fahmi continued.

Then the third, Fahmi mentioned the existence of evidence in the trial that was used as a basis for considering and deciding to sentence 4 years and 6 months in prison. Then the fourth is about evidence and facts that are far from the truth.
"The third reason is that there is evidence that has never been confirmed in the trial but used as a basis for considering and deciding to sentence Gaga Muhammad to 4 years and 6 months. So that's the third reason. As for the fourth reason, it is related to the fact that the 4 years and 6 months sentence is not in line with the facts and far from justice and fairness," he said.
