Rezky Aditya Rejects Wenny Ariani's Request for DNA Test, Here's the Reason

Kapanlagi.com - The trial of Wenny Ariani's lawsuit against artist Rezky Aditya regarding the acknowledgment of their child was held again at the Tangerang District Court on Wednesday, January 5, 2022. In the trial, Rezky Aditya through his legal representative submitted a document rejecting Wenny Ariani's request for a DNA test. The reason for Rezky Aditya's refusal to take a DNA test was read by the panel of judges in the courtroom.

"The plaintiff has absolutely no valid reason and legal basis to request the defendant to take a DNA test. It has been proven in the trial and supported by witnesses that there was no marriage between the plaintiff and the defendant, so it is highly unlikely for the defendant to be forced to take a DNA test," said the judge in the courtroom.

"It has been proven in the trial that the plaintiff cannot provide evidence that the plaintiff and the defendant have an intimate or special relationship between them. C. It has not been proven that the plaintiff and the defendant have a romantic relationship. D.The plaintiff's child was born while still in marriage with the plaintiff's husband.E.The plaintiff cannot provide evidence or witnesses indicating the biological relationship between the defendant and the plaintiff's child," he continued.

"F.The plaintiff never demanded accountability from the defendant since the beginning of the pregnancy until the plaintiff's child reached the age of eight or at least demanded to marry the defendant when realizing her pregnancy or at least demanded recognition of the child when making the plaintiff's child's birth certificate.Based on legal facts supported by witnesses in the trial, it is highly unfounded and legally unreasonable for the plaintiff to request the defendant to undergo a DNA test.I, the undersigned legal representative of Rezky Aditya," said the Panel of Judges.

1. Wenny's Objection

In response to Rezky Aditya's refusal to undergo a DNA test, Wenny's legal representative, Hakam SH, MH objected.

"According to us, the content of the letter is a subjective opinion conveyed by the defendant through his legal representative. That's why we object and are disappointed when the defendant refuses to take a DNA test. There must be something he is hiding," said Hakam.

2. Submit Other Evidence

Furthermore, in response to Rezky Aditya's rejection, Hakam, SH.MH. tries to submit Wenny as evidence by swearing that she had a special relationship with Rezky Aditya.

"To resolve the issue related to the lawsuit we filed, the DNA test is the only solution. However, it was rejected, so we humbly request to grant a suppletory or, if not, a decisory is also acceptable," said Hakam.

However, unfortunately Hakam's request to make Wenny as evidence was rejected by the panel of judges.

"At the request of the plaintiff's representative, the panel of judges cannot do it. The oath can be taken if there is no evidence presented. Because previously you have submitted several pieces of evidence," said the panel of judges.

4. Wenny Walk Out

The atmosphere then heated up with a debate between Wenny's legal representative and the judge regarding suppletoir and decisoir. Eventually, Wenny's legal representative decided to walk out of the trial.

"Alright, if Your Honor thinks that way, we will walk out of the trial," said Hakam, who then immediately left the courtroom followed by Wenny.

5. Protests and Disappointment towards the Judge

Outside the courtroom, Hakam stated that his walkout was a protest against his disappointment towards the panel of judges.

"This walkout is our form of protest because the judges did not grant the suppletoir or decisoir even though in civil procedural law, an oath is recognized," he said.
