Producer 'ENOLA HOLMES' Responds to the Lawsuit of the Sherlock Holmes Creator's Family

Released on September 23, 2020 on the Netflix platform, ENOLA HOLMES tells the story of the famous detective Sherlock Holmes' younger sister. Enola Holmes is portrayed as searching for her mysteriously missing mother, while also escaping from the constraints of her brothers, Sherlock Holmes (Henry Cavill) and Mycroft Holmes (Sam Claflin).

Adapted from the book of the same name written by Nancy Springer, this film is loved by Netflix viewers for its mystery and detective-like obstacles. However, the release of this film also faces obstacles. The family of the creator of the Sherlock Holmes books is suing ENOLA HOLMES for alleged copyright infringement.

1. Portraying Emotions of Sherlock Holmes

The lawsuit filed by members of Arthur Conan Doyle's family (the original author of Sherlock Holmes) refers to the portrayal of Sherlock Holmes in the film. They state that Sherlock Holmes portrayed by Henry Cavill in the film has a character that is “excessive” and sympathetic towards others. They consider such a portrayal of Sherlock Holmes to be their own.

For your information, in 2014, the court ruled that all Sherlock Holmes stories written before 1923 are in the public domain, while the last 10 stories written from 1923-1927 are owned by members of Arthur Conan Doyle's family who are part of the Conan Doyle Estate.

In the last 10 stories, Sherlock Holmes is depicted as losing his loved ones, making him more sympathetic towards others. Sherlock Holmes featured in ENOLA HOLMES according to Conan Doyle Estate is the same as the book version of Sherlock Holmes they own.

2. ENOLA HOLMES Producer Responds

The lawsuit filed by Conan Doyle Estate is directed at several parties, namely Netflix as the streaming platform that provides ENOLA HOLMES, Legendary Pictures as the company that produced ENOLA HOLMES, Penguin Random House as the distributor of the book ENOLA HOLMES, and Nancy Springer as the author of the book ENOLA HOLMES.

Nicolas Jampol, the lawyer representing the defendants, said that ideas, feelings, emotions, and human nature cannot be protected by copyright law. He told The Hollywood Reporter that even if emotions and human nature are protected by law, they are still ideas that cannot be protected by copyright law.

Jampol also included several Sherlock Holmes stories that belong to the public domain, in which the detective has a “kind” and sympathetic nature. “In Sherlock Holmes of 1892, it is told that Sherlock Holmes helps a woman in need selflessly.” He suspects that the plaintiffs are doing everything they can to make Netflix and other defendants pay them for something that has always belonged to the public. Jampol and his team are currently filing an appeal to dismiss the lawsuit.
