Paula Verhoeven Reports Judge of South Jakarta Religious Court to the Supreme Court

Paula Verhoeven through her legal team reported the judge of the South Jakarta Religious Court to the Supervisory Agency of the Supreme Court of the Republic of Indonesia (Bawas MA RI). This report relates to the divorce trial process between Paula and Baim Wong, which is considered inconsistent with judicial regulations.

This step was taken after Paula's legal team discovered alleged administrative violations during the trial proceedings. They noted at least three important points that are considered to violate the rules.

"Why are we going to the MA Supervisory Agency? Based on the results of the investigation and the judicial process we analyzed, there are clear allegations of administrative violations of the court in this trial process. We suspect there are 3 things, 3 points in the alleged administrative violations," said Erwin Natosmal Oemar, Paula Verhoeven's attorney, to reporters in Cempaka Putih, Thursday (24/4/2025).

One of the main points in question is the change in the trial system that was initially agreed to be online through e-court. However, without notice, the trial changed to face-to-face.

"But then in its implementation, Baim Wong and his legal team came to the court and asked the Panel of Judges to open it and then conduct interviews with the media," said Siti Aminah Tardi, another member of Paula's legal team.

Changes to the system without communication with Paula's party are considered a violation of the principle of equality in the judicial process. The legal team assesses that such actions violate the principle of hearing all parties.

"Meanwhile, we as representatives of Paula were not informed regarding the changes to the trial system. In the context of civil procedural law, this violates the principle of balance and the principle of hearing the parties," she said.

In addition, Paula's party also highlighted the dissemination of the divorce decision content which should still be in the documentation stage. In fact, according to the procedure, the content of the decision can only be accessed by the public after going through official stages.

"In our records, the decision is still in the minutization stage. Minutization is the documentation stage that will later be submitted to the archiving system and then uploaded to the website putusan.go.id. Decisions for the public can only be accessed through putusan.go.id and that is through a guidance process according to Supreme Court Decree number 144," said Siti Aminah.

Furthermore, they assessed that the dissemination of the contents of the decision was done with bad intentions. Paula's legal counsel believes there is a specific motive behind the leak of the document. "However, it then spread in such a way that we found it was constructed for things with bad faith," he continued.

Not only that, they also assessed that the dissemination of the contents of the decision contains violations of the Personal Data Protection Law. In fact, personal data in court documents should be protected and not published indiscriminately.

"At that point, matters related to personal data cannot be published. Even if it is a court decision, it cannot be published publicly, but there must be an anonymization process. However, as mentioned earlier, it seems that the court and many parties are not yet aware of this case," said Erwin.

On that basis, Paula's side requested that the MA supervisory body intervene to investigate this matter thoroughly. They believe this step is important to uphold justice in the legal process.

"Therefore, we ask the supervisory body to examine this. That is also what we requested to trace who and how the decision could reach the public without procedural processes," concluded Siti.
