Kapanlagi.com - Defendant Gaga Muhammad again attended a trial for a traffic accident case at the East Jakarta District Court on Monday (10/1/2022). The trial agenda is related to the plea or defense note of Gaga Muhammad.

In the defense note, this 21-year-old man admitted to deeply regretting the accident that occurred in 2019 due to his negligence.

"On this occasion, allow me to sincerely honor the victim, the victim's extended family, and my own extended family because I realize that the accident that occurred on December 8th was indeed my negligence and a stern warning from Allah SWT to myself, so that I always remain aware and cautious in my actions," said Gaga Muhammad in the trial on Monday (10/1/2022).

1. Accidents are Disasters

Gaga referred to the accident he experienced with his ex-girlfriend at that time, Laura Anna, as a disaster.

"I am sure that no one in this world can avoid accidents, including myself. As a faithful servant, this is a disaster and it is Allah's fate. No one can reject or avoid it, without us knowing when and where the disaster will happen," he said.

2. Not My Own Fault

The accident experienced by Gaga Muhammad was not solely his own fault. However, there was also negligence from Laura Anna, who was considered careless because of the imperfect use of seat belts.

"If the accident that happened to me and Laura Edelenyi was a disaster, my own negligence would not be wise. Because it is clear from the trial facts that the severe injury and paralysis suffered by Laura Edelenyi were not solely due to my negligence, but there were other parties involved," he said.

3. Laura Anna's Negligence

Laura Anna is said to be negligent for not wearing a seat belt properly. The negligence is deemed to have worsened Laura's injuries compared to Gaga's.

"The victim was negligent in using the seat belt at the time of the accident. As it is mandatory to use a seat belt, the victim only used the upper part of the belt while the lower part around the abdomen was not fastened," said Gaga Muhammad.

Meanwhile, Gaga Muhammad, who was wearing a seat belt properly at the time, only suffered minor injuries. This was also proven by the absence of any injuries on the abdomen or waist in his medical report, as evidence of wearing a seat belt.

"On the other hand, I, who wore a seat belt properly, have abrasions on my abdomen as stated in the medical report number 86SM/XT/Per/Xii/2020. Therefore, due to this negligence, the victim suffered severe injuries while I, who wore a seat belt properly, suffered minor injuries," he said.

5. Already Reminded

Gaga Muhammad said he had reminded Laura Anna to wear a seat belt. However, Laura Anna ignored Gaga Muhammad's advice.

"That previously I had reminded the victim to wear a seat belt properly but the victim did not listen. It is suspected that there was negligence on the part of the hospital for being late in handling the victim, to expedite the examination, and to take the victim's emergency more seriously," he said.

"Even though she had complained of pain in the neck and back. When the victim was brought into the emergency room, serious treatment was done on the fourth day. Since the victim was taken to the hospital from December 8, 2019 to December 11, 2019," Gaga Muhammad concluded.
