Ruben Onsu Seeks Legal Certainty Regarding Child Custody in Court

Ruben Onsu decided to pursue legal action regarding child custody after assessing that the agreement previously made in front of a notary had not been implemented as agreed. Through the lawsuit that has been filed, Ruben hopes to obtain legal certainty regarding his rights to meet with his children.

Ruben's attorney, Minola Sebayang, explained that previously both parties had an Act Number 39 created in front of a notary. This act regulated the schedule for Ruben to meet with his children. However, according to him, the implementation of this agreement did not proceed as it should.

"As stated in deed 39, it is actually final; only the implementation does not align with what has been agreed upon. The children should gather two to three days a week with Ruben," said Minola Sebayang when met in Jakarta via virtual interview on Friday (3/7/2026).

Minola stated that, legally, agreements made in the presence of a notary have binding force for the parties involved. However, because the implementation is deemed unrealized, Ruben chose to seek legal certainty through the court.

"But it has not been realized as stated in deed 39. In fact, based on the principle of pacta sunt servanda and also the Civil Code, it is stated that agreements made by the parties are binding as law for the parties that create them. But it has not been realized. Therefore, we want an agreement whose implementation can be measurable," explained Minola.

Through this lawsuit, Ruben hopes that the meeting schedule with the children has a clearer legal basis so that its implementation can run consistently and provide certainty for both parties.

Although he has taken legal action, Minola emphasized that his side remains open to the possibility of resolving the matter through mediation. If the proposal submitted is accepted by Sarwendah and turned into a court legal product, Ruben does not rule out the possibility of withdrawing the lawsuit.

"If our mediation proposal is accepted by party S and then becomes a court product stating that the lawsuit is not continued because there is a peace agreement between the parties, which points are in accordance with the submitted proposal, then it would not be a problem if the lawsuit is withdrawn," he said.
