The Attorney Asserts That Tengku Dewi Has Never Withdrawn Her Divorce Lawsuit, Either Verbally or in Writing

Kapanlagi.com - The artist Tengku Dewi Putri was recently reported to have withdrawn her divorce lawsuit against her husband, Andrew Andika, at the Cibinong Religious Court. However, the news was immediately denied by Tengku Dewi through her attorney, Minola Sebayang. Minola emphasized that her party has never withdrawn the divorce lawsuit that Dewi filed on July 4, 2024.

"This is what we want to clarify. Regarding the information that Tengku Dewi's lawsuit has been withdrawn. According to the decision available in the e-court which states that the plaintiff has withdrawn her lawsuit," said Minola Sebayang at her office on Tuesday (20/8).

Minola also stressed that both Dewi personally and she as the attorney have never withdrawn the lawsuit, either verbally or in writing.

"So Tengku Dewi has never withdrawn the lawsuit. Neither verbally nor in writing. We as her attorneys have also never formally withdrawn the lawsuit that we registered in the e-court," she stated.

1. The Withdrawal of a Lawsuit Cannot Be Done Arbitrarily

Furthermore, Minola explained that in procedural law, the withdrawal of a lawsuit cannot be done arbitrarily. Just like filing a lawsuit which requires authority from the client, withdrawing a lawsuit also requires permission and authority from the client.

"If we talk about procedural law, not only do we need to add authority from our client when filing a lawsuit, but when withdrawing a lawsuit, we also need permission and authority from our client," he said.

2. Divorce Process Delayed

Although the judge emphasized that legally there is no obstacle for a pregnant woman to file for divorce, he still gave subjective advice, suggesting that Dewi consider postponing the process.

"Well, in the hearing there is indeed some communication and dialogue, where the panel of judges asked Tengku Dewi about her seriousness in taking divorce action against her husband while she is pregnant. Although the judge also said that legally there is no obstacle for a pregnant woman to file for divorce," he explained.

"But he suggested, he urged that subjectivity whether it would be better to wait? Well, Dewi only stated in the hearing that she is not in a hurry. This means that if the process is delayed until she gives birth, that is not a problem," Minola added.

3. Dewi's Party Was Also Surprised

However, what surprised Dewi's party was when a decision appeared in the e-court stating that the lawsuit had been withdrawn by the plaintiff.

"That was what happened during the dialogue in the hearing until finally the session was closed, declared finished, and they went home from the Cibinong religious court. What was surprising was that a decision then appeared in the e-court regarding the case stating that the lawsuit had been withdrawn by the plaintiff," he concluded.
