Student Who Stabbed a Robber in Self-defense Sentenced to a Year of Rehabilitation

Kapanlagi.com - ZA, a student who stabbed a robber in Malang Regency, East Java, has finally been sentenced to a year of rehabilitation at the Children's Social Welfare Institution (LKSA). Single judge Nuny Defiary handed down the verdict in an open hearing.

"First, the child is proven to have committed the criminal act of assault resulting in death. Second, imposing punishment of rehabilitation at LKSA for one year in Wajak, Malang Regency," said Nuny Defiary during the trial at the District Court (PN) Kepanjen, Malang Regency, Thursday (23/1).

The judge also emphasized the need for guidance and counseling for ZA during the execution of the sentence. The judge also gave the convict 7 days to file an appeal in the next level court.

The verdict is in accordance with the demand of the Public Prosecutor (JPU) as stated in the previous indictment. The JPU demanded punishment for the defendant, who is still in 12th grade of high school, as he was considered guilty and proven to have committed an act of assault resulting in someone's death.

ZA has been proven and legally and criminally found guilty of committing the crime of assault that resulted in the death of a person as regulated in Article 351 of the Criminal Code paragraph 3.

ZA's Legal Power Coordinator, Bhakti Reza Hidayat, stated that ZA was charged with Article 351 paragraph 3 because the judge considered that he had enough time to stab. However, the judge did not consider Article 49 of the Criminal Code.

"ZA indeed stabbed, but the judge did not see why he did it," Bhakti emphasized.

2. Undecided

Meanwhile, regarding the one-year rehabilitation sentence at LKSA in Wajak, Malang Regency, they have not yet determined their stance. ZA and his family still have one week to make a decision.

"We are still considering, there is still one week left," Bhakti emphasized.

Meanwhile, the trial lasted for about an hour and was open to the public. This trial is different from previous ones which were always closed.

ZA himself sat in the defendant's chair wearing a mask and a hat. He also still wore a white uniform.
