Kapanlagi.com - Muhammad Anis Basurrah, the husband of Dhawiya Zaida, has been sentenced to 5 years in prison for conspiracy to commit drug abuse. The verdict was read during the sentencing hearing held at the East Jakarta District Court on Friday (3/7/2020).

Upon hearing the judge's verdict in the hearing, Dhawiya felt deeply devastated and shed tears. However, the 34-year-old woman admitted that she had already anticipated the punishment her husband would receive.

"Yes, just as I had imagined, the judge's demand was 7 years with a fine of 1 billion rupiah or 6 months imprisonment. I am sure the verdict cannot be far from that. I am truly speechless and unable to speak, but I will still strive for justice for my husband," Dhawiya said.

1. File an Appeal

Dhawiya, accompanied by her legal counsel, is currently seeking an appeal because the verdict does not correspond to the facts that have been revealed. It is mentioned that there was a conspiracy between the first defendant, Muhammad Anis Basurrah, and the second defendant, Muhammad Syafiq, in the misuse of methamphetamine.

"We are filing an appeal because the facts revealed in the trial do not show any malicious conspiracy as demanded by the prosecutor. The facts revealed in the trial indicate that the two defendants did not plan in advance to use the substance together, as stated in the defendant's testimony. Therefore, we are seeking an appeal," said Malwan Hadiman, Dhawiya's legal counsel.

2. Feeling Oppressed

Furthermore, Dhawiya, who feels oppressed, explains the chronology of events involving the first and second defendants. Malwan asserts that there is no evidence of conspiracy between the two defendants.

"It is clear that we feel oppressed. The facts that were revealed, Article 127, were instead ruled as Article 112 juncto 123, which is not proven. What malicious conspiracy is being accused? Which facts were revealed in the trial that show the first and second defendants conspiring to use the methamphetamine?" Malwan firmly stated.

"Based on the evidence from the confiscated mobile phone, there is no evidence of conversation between the first and second defendants discussing the use of the substance together. Instead, the revealed facts show that the first defendant used the substance on her own, and then the second defendant came to handle the passport. Later, after eating and going to the bathroom, the second defendant found the methamphetamine and smoking paraphernalia and asked the first defendant for it. So, there was no malicious conspiracy, just a coincidence," he continued.

3. Cannot Communicate Yet

Until the trial is held, Dhawiya has not had the opportunity to meet and communicate directly with her husband at all.

"Cannot communicate yet, cannot have the opportunity to visit. The last contact was related to the demands and I communicated with the lawyer for justice," said the youngest daughter of Elvy Sukaesih.

4.

Dhawiya, who hopes for a smooth verdict trial, admitted that she had asked for prayers from her family so that the injustice suffered by her husband could be resolved quickly.

"I talked to my family, asked for prayers. They tried to strengthen me. We were all shocked because we all know that Muhammad is a victim of abuse. Even when he was arrested, he was in the treatment period at RSKO," she concluded.
