Absent Witness, Trial of Gisel and Nobu's Explicit Video Spread Postponed

Kapanlagi.com - The trial of the case of the dissemination of explicit videos involving artist Gisella Anastasia alias Gisel with defendants PP and MN was held at the South Jakarta District Court on Tuesday (16/3).

This session's agenda was the examination of witnesses from the Jakarta Metro Police investigators. This was conveyed by the defense team's lawyer, Andreas Nahot Silitonga, after the trial.

"Today is the second witness examination session. The first one yesterday involved three witnesses who were the complainants. Today, there were supposed to be two investigators. However, the prosecutor's office informed that they couldn't attend and had other commitments, so the trial was postponed," said Andreas Nahot at the South Jakarta District Court on Tuesday (16/3).

1. Did Not Intend to Spread

Since the witnesses brought by the prosecutor's office couldn't attend due to other commitments, the trial was automatically postponed until March 23, 2021. "So, Tuesday, the 23rd, is only for the examination of witnesses," he said.

Andreas stated that his client never intended to spread the explicit videos of Gisel and Nobu. According to him, his client only asked about the video in a WhatsApp group.

"There are two articles. The first is about pornography and obscenity, and the second is about the Information and Electronic Transactions Law (UU ITE) and the maximum punishment for pornography is 12 years, while for UU ITE, it is a maximum of 6 years. Our client was just a branch, the difference is that our client sent the content while asking and after three minutes, he explained it to the group of five people," said Andreas.

2. Cannot Be Determined When It Will Be Present

Meanwhile, regarding Gisella Anastasia and Michael Yukinobu de Fretes alias Nobu being presented in court, Andreas cannot determine when both of them can be presented as witnesses.

"Yes, maybe after that GA and Nobu will be witnesses. But there are several names mentioned in the GA and Nobu case file. But it's not certain whether all of them will be present," Andreas concluded.
